To monitor compliance with the amount of funding in public procurement will be under the new rules

The government has approved a new procedure for checking the compliance of documents with the approved financial security. It now corresponds to the control rules for parts 5 and 5.1 of article 99 of the Law N 44-FZ, which came into force on April 1, 2020.
What will be monitored
Schedules and appendices, notices, vendor identification protocols, draft contracts, and extracts from invitations and draft contracts for closed procedures will be checked against two indicators:
compliance with the amount of financial security;
compliance with the IRC.
In some cases, there will be no control (clauses 15 and 23 of the rules). Exceptions include, in particular:
purchases on the territory of a foreign country to provide customers who operate there;
the purchase of services in granting of loans;
purchases for energy service contracts.
How will the compliance with the amount of financial security be checked
Control will be performed automatically in the EIS if the information (documents) being checked is placed in the system (clause 17 of the rules). If the schedule provides for purchases that will be paid after plan period, we need to send data on volumes of means to conclude a state contract for a period exceeding the validity of the reported LBO (item "b" of paragraph 17 of the rules).
In some cases, you will need to send information to the controllers on paper and, if technically possible, on removable machine media. This is required, for example, for some purchases from a single supplier. The list of such situations is given in clause 13 of the rules.
The period for posting information in the EIS after verification depends on the type of document. In particular, for the schedule plan, the controllers will generate a notification in the system about its compliance with the rules no later than 1 business day from the day following the receipt of the document. Otherwise, the customer will be sent a report indicating violations (clause" d " of clause 17 of the rules). The Appendix to the schedule will be checked no later than 3 business days from the day following the day of its receipt for control (clause" d " of clause 18 of the rules).
For automated control, documents (information) will not be placed in the EIS until violations are corrected and repeated control is performed. If documents (information) that are not placed in the EIS do not have a check mark, the relevant documents will not be sent to the procurement participants.
The document control rules and a number of amendments to other government acts have been in effect since August 13.
