Optimization continues: public procurement simplification project submitted to government
On the website of the Ministry of Finance, information appeared that the revised draft amendments to Law N 44-FZ were submitted to the government.
In it, in particular, adjusted the features of competitive procurement. So, it will be possible to conduct a quotation request in electronic form if the NMCC does not exceed 3 million rubles. At the same time, the annual volume of purchases in this way should be no more than 50% of the SHOZ (pp. 22 - 23 of the Project). We will remind, earlier the Ministry of Finance proposed to carry out such purchases without restriction on SHOZ.
It is also proposed to amend procurement regulations from a single supplier. They want to legislatively consolidate that to produce goods (perform work, render services) the institutions of penal correction system are obliged personally (p. 228 of the Project). Recall that the antitrust authorities consider it unacceptable to involve third parties in the execution of such a contract.
In a non-competitive way it will be possible to purchase construction work to prevent emergency and emergency situations for regional needs. Such a purchase will be carried out from a single supplier (contractor, contractor), which will be determined by the highest executive authority of the constituent entity of the Russian Federation. It will be financed from the reserve fund of this authority. The annual volume of such purchases should not exceed 3% of the budget of the subject of the Russian Federation. In this case, it will be necessary to justify the price of the contract (pp. 229 - 230 of the Project).
It is planned that the amendments will enter into force in stages. Transitional provisions are also provided (pp. 301 - 319 of the Project). The first innovations should earn in July 2020.
