The Ministry of construction proposed uniform rules for procurement under the Law N 223-FZ of construction works "turnkey"
The Agency has prepared a draft law on the specifics of concluding and executing a contract, the subject of which is simultaneously:
- works on preparation of project documentation and (or) execution of engineering surveys;
- works on construction, reconstruction and (or) overhaul of the capital construction facility;
- delivery of equipment (if it is provided by the design assignment and / or project documentation and is necessary to ensure the operation of the object under construction).
Such purchases will be possible if the work is financed from the funds of legal entities specified in the GRC of the Russian Federation. Customers in their position will be able to determine additional cases of purchasing construction works "turnkey".
The result of the contract will be a built and (or) reconstructed capital construction object that has been put into operation.
We will remind that earlier the FAS gave explanations about the purchase of construction works "turnkey" under the Law N 223-FZ. She pointed out that since there is currently no established procedure for conducting them, it is possible to apply paragraphs 55 - 57 of article 112 of the Law N 44-FZ to form the object of purchase, if this does not contradict the provision on procurement.
Public discussion of the project will last until June 8, 2020.
