The government approved the cases and procedure for emergency public procurement from the supplier before the end of the year

Since may 10, a decree has been in effect, which defines new cases and the procedure for purchasing from a single supplier (contractor, performer) until the end of 2020. There are also rules for calculating deadlines for conducting purchases on non-business days.

When are emergency purchases made?

They will be conducted in a non-competitive manner if:

- procurement for state or municipal needs was determined by the minutes of the government meeting, the minutes of the coordinating and Advisory bodies under the Prime Minister, the plan of priority measures to ensure sustainable economic development in the face of a worsening situation with coronavirus, which was approved by the President, the government (its Chairman);
- the specific purchase was determined by the minutes of the government meeting, the minutes of the coordinating and Advisory bodies under the Prime Minister, and the plan of priority measures to ensure sustainable economic development in the context of the worsening situation with coronavirus;
- purchases are made for Federal needs from a single supplier designated by the order of the Prime Minister to implement the decisions of the coordinating Council under the government to combat the spread of coronavirus, a plan of priority measures to ensure sustainable economic development in the face of a worsening situation with coronavirus, which is approved by the President, the government (its Chairman);
- procurement is carried out at the expense of the reserve funds of the government, the highest Executive bodies of the subjects.

In what order are purchases made
These purchases are made on the basis of a decision of the government, Executive body of the subject or municipality. It must include information from paragraph 2 of part 1 of article 93 of the Law N 44-FZ.

In the contract, you must specify the basis (listed above) for which the purchase is made, and justify the contract price.

Within three days after the date of conclusion of the contract, customers must send a notification of such a purchase to the control authority. You must attach a copy of the contract to it.

How time limits are calculated for purchases on non-business days

In the period of non-working days established by the President, when calculating the terms, it is necessary to use the rules that were applied for purchases before April 30, 2020.

So, in addition to Saturday and Sunday, calculations do not need to take into account non-working holidays.
