In the notification, you can not use phrases that refer to public procurement documentation without specifying the following points
The customer published the notice and used a link to the documentation in the section "Procedure for providing security for the performance of the contract, requirements for security, information about Bank support of the contract". It used the phrase "in accordance with documentation"instead of specific information.
The control body recognized this as a violation, and the courts supported its position.
Information about contract enforcement must be specified in both the notice and the electronic auction documentation. The main purpose of the notification is to attract interested participants. It must contain certain information in order to quickly make a decision whether to participate in the purchase or not.
The law N 44-FZ does not prohibit setting reference phrases from the notification to the terms of documentation. However, you must specify specific items and sections of the documentation that contain the necessary information. This was not done in the present case.
The Supreme court did not review the case.
