Ministry of Finance: what to require in the first part of the application for public procurement of works or services

As of January 1, 2020, the new version of the regulation defining the first part of the application for participation in an electronic auction is in effect. Thus, in paragraph 2 of part 3 of article 66 of the Law N 44-FZ, the words "or procurement of work, services, for the performance of which the goods are used" were replaced with the words "including those delivered to the customer when performing the purchased work, rendering the purchased services".

The Agency explained that when purchasing goods that are delivered to the customer when performing the purchased works (providing the purchased services), the first part of the application must require:

consent to perform work (provide services) on the terms of documentation;

name of the country of origin;

specific indicators of product;

trademark (if available).

When purchasing a product that is used to perform work (provide services), only the participant's consent is required.

Note that this approach is also reflected in law enforcement practice. Thus, the control body recognized the customer's demand to specify specific indicators of goods (materials) used in the performance of work as illegal.
