In the purchase, the characteristics of only one specific model are stated — the car will have to be returned

The institution held an auction for the purchase of a car. According to the results of the auction, a contract was signed and the car was transferred to the institution.

The Prosecutor's office considered the purchase illegal: under the parameters contained in the technical task, the car was suitable for only one specific brand and model.

The Prosecutor's office through the court demanded that the parties to the contract return the car and the money received for it. The courts of three instances supported the requirement.
