Product requirements have limited competition
The customer provided specific standards and supported audio compression algorithms for the purchased equipment in the technical task. The participant appealed to the control body, since the set indicators corresponded to the equipment of only one manufacturer.
The customer explained that these characteristics of the equipment are necessary for connecting to a secure data network, that is, related to its need.
The control body found that the absence of set compression parameters will not make it impossible to combine the purchased equipment with what is already available. The customer could not prove otherwise.
National mode rules are not observed
The customer announced a tender for the supply of equipment for holding video-conferencing. The object of the purchase was also part of the software. The documentation should have taken into account the rules of application of prohibitions and restrictions on the admission of foreign goods, but the customer did not do this.
First, it did not establish a ban on the admission of foreign SOFTWARE in the documentation and did not place a justification in the EIS for why it cannot be observed. Secondly, in the information card, he indicated that restrictions and conditions of admission apply to the purchase, but did not require documents from the participant confirming compliance with this requirement.
The control body recognized this as a violation.
Instructions for filling out applications are made with violations
The procurement participant did not understand from the instructions what characteristics of the goods should be specified in the first part of the application, and complained to the control body.
The customer has determined that the participant must specify if the value of the product parameter is accompanied by the words "from" and "to", "from" or "to". However, he did not explain in the instructions what a number of symbols that he used in the description of the purchase object means (for example, the words "not already" and the symbols "x", "/", ":", "-" "+").
The FAS recognized this as an administrative offense.
