A draft resolution has been prepared with the size of n, in case of exceeding which customers will be obliged to agree on contracts with the supplier after failed electronic procedures: competition, auction and request for proposals. The amendments also apply to closed procurement methods.

What price thresholds do they want to set

Prices will vary depending on the level of the customer, as well as the method of determining the winner of the purchase. Thus, the document provides for the following price thresholds:

For Federal needs:

1 billion rubles - at auction;

20 million rubles - for a competition, a competition with limited participation, a two-stage competition, and a request for proposals.

For regional and municipal needs:

100 million rubles — at auction;

10 million rubles - for a competition, a competition with limited participation, a two-stage competition, and a request for proposals.

With closed methods of purchase – 1 thousand rubles.

It is also planned to approve the procedure for approving the conclusion of a contract with a single supplier. Let's look at its main points.

For approval, you will need to form an appeal, attach the necessary documents to it and send it to the control body.

In what form will the appeal be submitted

In case of electronic procurement, the request will need to be created in electronic form in the EIS and signed with a strengthened qualified electronic signature (paragraph 9 of the draft procedure).

In closed procurement methods, it will be submitted on paper in a single copy and, if technically possible, on a removable machine medium without using the EIS (paragraph 10 of the draft order). In this case, the request will need to be made in the form specified in the Annex to the draft order.

It is planned that such rules will be effective from January 1, 2021. Until this date, all requests will be submitted "on paper" without using the EIS.

What information and documents will need to be attached

The draft procedure provides detailed lists of information and documents that will need to be attached (generated) to the application. You will need, for example: applications (or copies of them) to participate in the electronic procedure, documentation (or a copy) of the purchase in the closed method.

How soon will they agree or refuse

The decision will be made no later than 10 working days after the date of receipt of the request (item 11 of the draft order). During this time, the control body will review it and conduct an unscheduled inspection. If a positive decision is made, but violations are found in the terms of the contract, then an order will be issued. It will indicate the actions to be performed when concluding the contract (paragraph 12 of the draft order). The decision will be sent in the same way as the appeal was submitted.

When the conclusion of the contract is not approved

The control body will refuse to enter into a contract with a single supplier (clause 13 of the draft procedure) if, for example, it finds that the customer:

chose the wrong way to purchase;

restricted competition in the description of the purchase object;

established requirements for participants in violation of the law on the contract system.
