The draft Federal law provides for five main changes:
Procurement participants will be able to submit complaints electronically. Only users who have registered in the unified information system (part 5 of article 24.2 of Law No. 44-FZ) are entitled to participate in purchases. Experts of the Ministry of Finance believe that it is appropriate to allow participants to send complaints about the actions or omissions of control subjects in electronic form through a single information system.
Universal cost prequalification. In order to appeal a purchase with an initial maximum contract price of more than 20 million rubles, the participant must execute at least one contract for at least 20 percent of the initial maximum contract price of the purchase contract to which the complaint is filed.
They plan to reduce the time for filing a complaint about the provisions of the procurement documentation. The bidder has the right to file a complaint before half of the deadline for submitting bids for participation in the purchase has expired. Now any participant can submit a complaint before the end of the deadline for submitting applications for participation in accordance with part 3 of article 105 of Law No. 44-FZ.
You can file complaints about the provisions of the procurement documentation once. So far, such a complaint can be filed from one person several times.
You can appeal the actions of the customer in relation to a particular bidder when the application for participation has ended. Appeal against the actions or omissions of the customer in respect of other participants in the purchase is excluded.
If the bidder does not agree with the actions of the customer or the provisions of the procurement documents, then file a complaint with the FAS. The complaint is filed in writing, attach documents that confirm their arguments. The Antimonopoly service will not consider the complaint if it violates the provisions of the regulations from the FAS order No. 727/14 of 19.11.2014.
