Plan to introduce new rules of the national regime in public procurement: how will the restrictions of admission

Which positions will be subject to the new restrictions

Restrictions will be imposed on many foreign goods, the purchase of which is now subject to bans. If the projects are approved, from January 1, 2020, the bans will apply only to purchases carried out in the interests of defense and security of the state. Other purchases will be subject to restrictions and admission conditions.

This will affect the products:

light industry;

furniture and woodworking industry;

chemical industry;

the machine-tool industry;

heavy engineering;

power engineering, electrical and cable industry;

radionics;

branches of special mechanical engineering (agricultural, food and construction and road engineering);

motor industry.

Restrictions want to establish and for the following production:

oil and gas engineering;

building materials industry;

the field of metallurgy and materials;

medical industry;

sporting weapons (with the exception of a few cases);

sporting goods;

products to the rehabilitation industry;

musical instruments and sound equipment;

baby products.

Restrictions will be established not only for goods, but also for works and services with which goods from the list are purchased.

It will not be possible to combine the goods included and not included in the list in one purchase.

It should be noted that with the advent of new restrictions, only the current restrictions on the purchase of foreign sports weapons will become invalid. Other restrictions will need to be applied further.

How will the new restrictions work

The customer will reject all applications (final proposals) in which participants offer to deliver goods not from the EAEU, while meeting the following conditions:

submitted at least two applications (final proposals) that meet the requirements of the procurement documentation;

these applications contain proposals for the supply of goods from the list, the country of origin of which are only the member States of the EAEU;

these applications do not contain proposals for the supply of the same type of industrial goods of one manufacturer or manufacturers belonging to the same group of persons under the law "on protection of competition".

When purchasing certain items, the customer will set an additional requirement for participants. In the production of textile products listed in the project, they will have to use fabrics, materials or semi-finished products from the list originating from the EAEU countries.

If restrictions are not applied to an application or final offer for a foreign good, the conditions of admission will apply to them, provided that they are established for the purchased goods. It should be noted that the list of goods subject to the conditions of admission, also plan to change.

If the Commission rejected applications as a result of restrictions, it will be impossible to replace the purchased goods with products not from the EAEU countries during the execution of the contract.

Within 10 working days after the conclusion of the contract, the customer will be required to post information about the results of the purchase through the GIS.

As participants will be required to confirm compliance with the new limitations

To confirm compliance with the new restrictions, the participant will only need to declare in the application the country of origin of the goods and the presence of a document confirming it.

When performing the contract, the counterparty will have to submit an extract from the register of Russian industrial products, formed with the help of GIS, or a copy of the certificate СТ-1, if the products do not appear in this register.

When will the new rules work

Like the bans, the new restrictions are due to take effect on January 1, 2020. They will not need to be applied to purchases initiated before that date.
