Offer in a new way to coordinate the conclusion of the contract with the supplier after the failed purchases

The basis for agreement on the conclusion of the contract will be changed

The need to agree with the Supervisory authority on the conclusion of the contract will be influenced by two factors: the method of initial purchase and the initial maximum price of the contract

The customer will send a request for approval to the Supervisory authority, if there is no competition, auction or request for proposals, namely:

a closed tender, tender with limited participation, two-stage tender or auction;

open competition, limited competition or two-stage competition if only one application has been submitted or remains;

electronic competition if only one application has been submitted or remains;

electronic auction, if only one bid has been submitted or remains, as well as if no bids have been submitted;

request for proposals (including in electronic form) if only one application has been submitted or remains, as well as if no application has been submitted or all participants have been rejected.

Thus, the conclusion of the contract will also need to be agreed after the failed electronic procedures. However, it is not a fact that in the end the conclusion of contracts will have to be agreed more often. This will only be needed for purchases that exceed the size limit. It will be installed by the Government.

The customer will have less time to prepare an appeal to the Supervisory authority

The customer will have to send an application for approval within 5 working days from the date of placement of the Protocol in the EIS or its signing (if by law it does not need to be placed in the EIS). Now it is given 10 calendar days.

The Supervisory authority will conduct an unscheduled audit of such purchases

During the consideration of the appeal, the control body will conduct an unscheduled audit of the purchase. If violations are found, the contract can be concluded only after the execution of the order issued by the results of the inspection. If necessary, the customer will adjust the draft contract and send it to the participant.

Specify the period in which you need to conclude a contract with a single supplier

The contract will need to be concluded not earlier than 10 days from the date of placement of the Protocol in the EIS or its signing and not later than 20 days from the date when the customer receives a decision on approval.
