Public discussion of purchases for 2020 is planned to be held under the new rules

The Ministry of Finance has proposed new rules for mandatory public discussion of purchases. The current government resolution of 22.08.2016 № 835 plan to cancel. If the draft is adopted, the new rules will come into force on October 1, 2019.

For what purchases will be held public discussion

Public discussion will be held during procurement by tender or auction with an initial maximum contract price of 1 billion rubles while public discussion will not be required for procurement:

closed way;

as part of the state defense order;

works on construction, reconstruction, overhaul, demolition of the capital construction object by electronic auction at the initial maximum contract price up to 2 billion rubles.

Who will conduct the public discussion

Public discussion is conducted by the customer. If the customer transfers the authority to another legal entity, the public discussion shall be held by such organization.

Who will participate in the discussion

Any legal entities and individuals will be able to participate in the public discussion on equal terms. Participants are registered in the EIS and post comments and suggestions in the section "Mandatory public discussion of procurement". Comments and proposals are pre-checked in the closed part of the EIS and published in the open part of the system no later than one calendar day following the day of their receipt.

In what order will the public discussion be held

Public discussion begins when the EIS posted a schedule and continues until the date when the customer has the right to cancel the purchase.

Participants in the discussion send comments and suggestions. The customer within two working days places in a specialized section of the EIS response. As a result of the discussion, the customer has the right to make changes to the schedule, purchase documentation or cancel the purchase.

The new rules will apply to purchases that customers plan to make in 2020 and beyond. Public discussion on the procurement, which is scheduled for 2019, will be held according to the current rules of the Resolution No. 835.
