Having terminated the contract concluded before July 1, the customer has the right to conclude a contract with the second participant without a new purchase

On July 1, the new part 17.1 of article 95 of the Federal law of April 5, 2013 No. 44-FZ "on the contract system in the procurement of goods, works and services for state and municipal needs"came into force. It allows the customer, in the event of termination of the contract with the winner of a competitive procurement, to conclude a contract with the second participant in this procurement.

Experts of the Ministry of Finance of Russia pointed out that the provisions of this rule apply including to contracts concluded before July 1, 2019.
