The government has adjusted the rules for determining the penalty for improper performance of the contract. Part of the amendments is of a technical nature and brings the rules in line with the may amendments to the Law N 44-FZ. However, there are significant innovations.
The size of the fine for improper execution of contracts concluded on the basis of purchases from small businesses and socially oriented non-profit organizations has changed. Under the new rules, it will be 1% of the contract price or its stage, but not less than 1 thousand rubles. and not more than 5 thousand rubles. Now the fine can reach up to 200 thousand rubles.
In another way, fines will be calculated for the executors of those contracts that are concluded based on the results of the purchase carried out to raise the price. If the contract concluded with the bidder who offered a price greater than the initial maximum price contract, penalties for breaches of obligations calculate based on the price of the contract. In other cases, they will continue to determine the amount of the fine based on the initial maximum price of the contract.
The new rules will work on August 14, 2019 and will not apply to purchases announced before this date.
