The Ministry of Finance told how to reject the application with improper Bank guarantee in its security
The Agency noted that there is no special provision in the Law N 44-FZ that allows to reject an application for participation in an electronic tender or auction, if the Bank guarantee that provides it does not meet the requirements.
However, participants should not be allowed to purchase in such situations. Everyone, with the exception of state and municipal institutions, must provide an application. The participant who submitted an improper guarantee does not meet the requirements of the legislation (paragraph 2 of the letter).
As the basis for rejection of the application the Ministry proposes to specify p. 3 h. 4 of Art. 54.7 or p. 2 h. 6 of Art. 69 of the Law N 44-FZ.
