The government supports the bill to clarify the term of payment of obligations under contracts under the Law № 223-FZ

Recall, the legislative initiative provides for a single for all contracts under the Federal law of July 18, 2011 № 223-FZ "On procurement of goods, works and services by certain types of legal entities" (hereinafter – the Law № 223-FZ) 30-day period for payment of obligations. According to the project, this period is calculated from the date of signing by the customer of the document on acceptance of the goods, performance of work or provision of services under the contract.

The Russian government conceptually supports the bill, but considers it necessary to finalize it. Thus, taking into account the wide range of subjects of purchase of goods, works, services carried out under Law No. 223-FZ, it considers it impossible to establish a mandatory payment term in all cases (for example, in the provision of insurance services, loans, etc.), and not only in respect of contracts concluded with small and medium-sized businesses, as provided today.

The Cabinet of Ministers sees a more successful version of the amendments in the consolidation of the Law № 223-FZ rules on payment by the customer of goods, works, services in a period not exceeding 30 days from the date of signing the document on acceptance of the contract (a separate stage of the contract), concluded on the results of the purchase with SMEs, as well as with other persons, unless otherwise established by the provision on procurement. At the same time, it is recommended to provide for the customer's obligation to establish a list of goods, works, services in the procurement of which other payment terms will be applied, or the procedure for their calculation.
