How to conduct public procurement with an unknown volume since July 1

If the customer can not calculate the need for any goods (except medicines), works or services, it will be possible to make a purchase with an uncertain volume. Three types of prices will be used: unit price, unit price sum and maximum contract price.

The starting price of the units and their starting amount will be calculated instead of the starting maximum contract price

Customers will calculate and justify the initial price of each unit of goods, works and services. You will need to use the same methods that determine the initial maximum contract price. The Ministry of Finance will develop recommendations for the calculation.

All received prices will need to be added up to find the initial sum of unit prices.

Sum of unit prices: for evaluation of applications, anti-dumping and advantages

Participants will make proposals not about the price of the contract, but about the amount of unit prices. This value will be used as a criterion for evaluating applications and final proposals. You will not be able to submit an offer that exceeds the initial price amount.

Anti-dumping measures the customer will apply if the participant offers an amount of prices that is less than the initial 25% or more. Other rules for the application of measures will be the same as in normal procurement.

The size of the benefits for organizations of persons with disabilities and institutions of the Executive system will also be calculated from the amount of prices offered by the participant.

Maximum price: for collateral and execution

The customer will determine the maximum value of the price based on the funds allocated for the purchase. From the maximum value of the contract price, the bid security and contract performance will be calculated.

The customer and the participant in the performance of the contract will not be able to go beyond the maximum price.

What information will be specified in the documents

The customer will indicate the initial unit price, the initial unit price amount and the maximum contract price in the notice.

The documentation will need to duplicate the price information and justify the initial unit price.

Both the notice and the documentation will need to indicate that payment is made at the unit price based on actual performance, but in an amount not exceeding the maximum value of the contract price.

The contract must reflect the condition that the volume of goods, works or services to be transferred or executed is determined on the basis of the customer's applications. You will also need to specify the maximum contract price and the price of each unit. To calculate the price per unit is possible by dividing the sum of the prices proposed by the participant on the initial amount, unit price and multiplying the result by the initial price of the unit.

When the new rule will work for the purchase of medicines

It will be possible to purchase medicines in an indefinite amount only from October 1.
