The Ministry of Finance of Russia explained the features of information exchange platforms and customers if the participant is not registered in the UIS

In the letter prepared by experts of the Ministry it is noted that according to h. 50 Art. 112 of the Federal law of April 5, 2013 No. 44-FZ "About contract system in the sphere of purchases of goods, works, services for ensuring the state and municipal needs" (further – the Law No. 44-FZ) till December 31, 2019 inclusive submission of applications for participation in electronic procedures and participation in them are performed including by persons who were accredited on the electronic platform till January 1, 2019, information and documents of which are included in the register, provided by Art. 62 of the Law № 44-FZ. In this case, the registration of these customers in the UIS is not required.

In this regard, the operator of the electronic platform in accordance with part 11 of Art. 24.1 of Law No. 44-FZ in respect of procurement participants not registered in the UIS, sends to the customer the information and documents included in the register provided for in article 62 of Law No. 44-FZ. At the same time, the Commission of the customer considers the information and electronic documents sent by the operator of the site and independently decides on the rejection of the application, guided by the provisions of the documentation and Law No. 44-FZ.
