The state Duma adopted in the third reading a bill that will allow cultural and educational institutions to carry out more purchases from the supplier. All budgetary institutions will be able to carry out purchases under the Law N 223-FZ at the expense of the means received as a gift or under the will.
Customers will be able to buy more from a single supplier according to paragraph 5 of part 1 of article 93 of the Law N 44-FZ
The organizations of culture and other customers listed in item 5 h. 1 of Art. 93 of the Law N 44-FZ will be able to sign the contract with the only supplier for the sum to 600 thousand rubles For an annual limit of such purchases provided two options:
not more than 5 million rubles.;
not more than 50% of the total annual volume of purchases and not more than 30 million rubles.
For example, the customer, whose SGOZ does not exceed 7 million rubles, will be able to conclude all contracts under this paragraph and paragraph 4 of part 1 of article 93 of the Law N 44-FZ, observing the requirements for the price of contracts.
Purchases on the presented money can be carried out under the Law N 223-FZ
This possibility is provided for purchases from funds received as a gift, including as a donation, and under the will.
Budgetary institutions will have to update or approve regulations on purchase and the purchase plan till October 1, 2019 if want to carry out this year such purchases under the Law N 223-FZ.
Will limit the ability to involve subcontractors in the execution of the contract
The customer will be able to include in the contract the condition of personal fulfillment of obligations, if it will carry out purchases under paragraph 2 h. 2 article 56, paragraph 2 h. 2 article 56.1, paragraph 3 h. 2 article 84 of the Law N 44-FZ.
Justify the conclusion of a contract with a single supplier will have less
The list of cases where the justification is not necessary, will complement the contracts:
for the supply of cultural property to replenish state funds;
for the purchase of works of art by certain authors and performers and the rights to them;
for the purchase of printed or electronic publications of certain authors from publishers, if they own exclusive rights or exclusive licenses;
on services in creation, execution of works of literature or art, production or delivery of scenery, suits, the theatrical requisite necessary for execution of works.
It will be possible to involve experts in the acceptance of contracts less often
External expertise when accepting a contract with a single supplier will be optional, if the purchase of cultural values for the replenishment of state funds or works of art of certain authors and performers.
