From July 1, the rules of control over state and municipal procurement will change
The Law N 44-FZ introduced a number of innovations relating to control issues. Thus, the government should establish a single procedure for inspections. Electronic procurement will follow more supervisors. The risk of cancellation of the purchase due to complaints of unscrupulous participants and public associations will be reduced.
It will be easier to understand the rules of checks
The control rules at the Federal, regional and municipal levels will be the same. The government will determine the grounds, subject, form, timing, frequency of inspections, the procedure for their conduct and registration.
In the organization of control will take into account the category of risk to which the customer or other subject of control. Most likely, this will depend on the frequency of scheduled inspections: the less likely violations, the less control. This is how the risk-based approach works when checking under the Law N 294-FZ.
The powers of regional and municipal supervisors will change
Regional and municipal authorities will monitor customers, commissions and other entities during electronic procurement at the stage from the placement of the notice to the conclusion of the contract. In the exclusive jurisdiction of the FAS will only check the operators of sites.
Regional inspectors will be able to check municipal customers and other subjects of control in a planned manner, if the local authorities agree with the authorities of the subject of the Russian Federation on the transfer of powers.
Recall, the control authorities of the Russian Federation have the right to carry out planned and unscheduled inspections in respect of regional purchases, as well as unscheduled in respect of municipal, municipal authorities control the procurement of its level.
