The Ministry of Finance of Russia: failure to specify the identification code of the purchase in the documents may entail liability
Experts of the Ministry of Finance of Russia recalled that in accordance with the Federal law of April 5, 2013 № 44-FZ "On the contract system in the procurement of goods, works and services for state and municipal needs" (hereinafter – the Law № 44-FZ), the IRS is indicated including:
in case of joint tenders and auctions (clause 1.1 of part 2 of article 25 of Law No. 44-FZ);
in the register of contracts concluded by customers (p. 12 h. 2 article 103 of the Law № 44-FZ);
in the register of unscrupulous suppliers (contractors, performers) (hereinafter – RNP) (p. 5 h. 3 article 104 of the Law № 44-FZ).
Thus, failure to specify the icz in the documents provided for by Law No. 44-FZ may entail liability established, in particular, part 1.4 of article 7.30 and part 1 of article 7.31 of the administrative Code.
Recall, in accordance with part 1.4 of Art. 7.30 of the administrative Code provides administrative responsibility for the placement of the customer's official, an official of the authorized body, an official of the authorized institution, a specialized organization in the EIS or the direction of the operator of the electronic platform of information and documents to be placed, direction, in violation of the requirements of the legislation of the Russian Federation on the contract system in the field of procurement. Also, administrative responsibility is provided for the inclusion of knowingly inaccurate information in the RNP (part 1 of article 7.31 of the administrative Code).
