The competition authority recalled that when the state customer shall not be entitled to limit the area of rendering services
The customer demanded in the request for quotations that the place of provision of services for inspection of buses and other vehicles was not more than one kilometer from its location. The territorial body of the FAS received a complaint about the restriction of competition.
In his defense, the customer cited data that within a radius of one kilometer there are several inspection points of different organizations. However, the applicant proved that all companies except one suspended certificates or do not have the necessary accreditation.
The Antimonopoly authority decided that in these circumstances the requirement of the place of rendering services is illegal.
Recall, the customer has the right to establish such a restriction, if it saves time or money and apply can be several participants. In addition to the fact of finding the relevant companies in the territory, we also recommend checking whether they have the necessary permits.
