It was proposed to set a deadline for payment of the purchase of 223-FZ

27 February 2019, Wednesday

The regional Duma proposed to change the terms in which the customer is obliged to pay the obligations under the contract. Amendments will be made to article 3 of Law No. 223-FZ.

In the text of the law proposed to identify the terms in which to pay for the delivered goods, the results of work and services provided under the contract or a separate stage. If the amendment is accepted, the payment deadline will be no more than 30 days from the date when the customer signed the acceptance documents.

The authors of the document proposed to establish a payment deadline by analogy with the 44-FZ. The law prescribes a deadline for payment of obligations regardless of the category of participant-30 days.

Now for customers on 223-FZ the law does not establish when it is necessary to pay obligations. The deadline is prescribed only for SMEs in the Government decree of 11.12.2014 № 1352. In other cases, the customer sets the deadline for payment of products. The form, term and order of payment must be prescribed in the procurement documentation.
