The government of the Russian Federation in accordance with part 4 of Art. 3.5 of the Federal law of July 18, 2011 № 223-FZ "on procurement of goods, works, services by certain types of legal entities" (hereinafter – the Law № 223-FZ) approved the Regulation on the peculiarities of document circulation in the implementation of closed competitive procurement in electronic form and the procedure for accreditation on electronic platforms for closed competitive procurement (hereinafter – the Regulation).
In particular, the Regulation establishes the procedure and terms of accreditation on electronic platforms, rules for maintaining the register of procurement participants. A list of documents and information that participants must provide to the operator of the site for accreditation, the composition of documents and information about the participants included in the register.
Also, the procedure for sending invitations to participate in closed electronic procurement and submission of documentation on closed procurement, the procedure for submission of applications by participants is fixed. In addition, there are features of document circulation at the conclusion of the contract on the results of closed electronic procurement (part 1 of article 3.5 of the Law № 223-FZ).
The regulation is effective from January 4.
As a reminder, a closed tender, a closed auction, a closed request for quotations, a closed request for proposals or other competitive procurement carried out in a closed way can be carried out only if information about such procurement is available:
constitute a state secret, or
not subject to placement in the EIS in accordance with the decision of the coordinating body of the Government of the Russian Federation on the basis of paragraph 2 or paragraph 3 of part 8 of article 3.1 of Law № 223-FZ, or the Government itself on the basis of part 16 of article 4 of Law № 223-FZ.
