Participants will be allowed to operate not only in the place that is prescribed in the license. Customers will be able to enter into contracts, even if the counterparty has not reissued the documents. The draft Federal law was developed and submitted for public discussion by the Ministry of industry and trade.
The regulations on the licensing of certain types of activities will allow you to install the work and services that organizations are entitled to perform out of place from the license, without reissuing the documents. Edits will make part 1 of article 18 of the Federal law of 04.05.2011 № 99-FZ.
The authors of the project explained that customers can not always determine in advance the place where they will carry out licensing work. For example, it is impossible to establish in advance where weapons and military equipment will be repaired. The technique often cannot move to industrial conditions or to carry home to recycle. Even when the equipment can be delivered to the place where the counterparty has the right to conduct licensed activities, transportation costs are comparable to the cost of repairs. The amendments, which were developed by the Ministry of industry and trade, will facilitate the purchase of works and services to maintain the working condition of weapons for which a license is needed.
Now the address from the license must match the place where the counterparty will perform the work or service. It is impossible to conduct activity not to the address from the document. The customer is obliged to reject the application if the counterparty has not reissued the license at the place where the work will be performed. Moreover, the participant is obliged to renew the license before submitting the application. The conclusion follows from the decision of the Supreme court of 10.08.2018 № 301-KG18-2640.
Activities for which a license is required are listed in the Federal law of 04.05.2011 № 99-FZ. When purchasing works and services from the list, the customer is obliged to prescribe a requirement for the participant to submit a license. Applicants who have not submitted a document should not be admitted to the procedures.
