The procedure for determining the types and volume of construction works under the contract, which the contractor must perform independently, has been adjusted
In accordance with the amendments to the decree of the Government of the Russian Federation No. 570 of may 15, 2017 (hereinafter – Resolution No. 570), the provisions of the said resolution shall be applied if the draft contract provides for construction and reconstruction of capital construction projects located on the territory of the Russian Federation.
These changes will come into force on November 30.
Recall that the Resolution № 570 in accordance with part 2 of Art. 110.2 of the Federal law of April 5, 2013 № 44-FZ" on the contract system in the procurement of goods, works, services for state and municipal needs " approved a List of types of construction, reconstruction of capital construction projects, which the contractor is obliged to perform independently without involving other persons to fulfill their obligations under the state and (or) municipal contracts (hereinafter – the List).
In the subparagraph " and " item 2 of the Resolution No. 570 it is established that possible types and volumes of works on construction, reconstruction of capital construction objects from among the types of works specified in the List are subject to inclusion by the customer in documentation on purchase.
At the same time in the subparagraph "b" of the same point it is specified that specific types and volumes of works from among the types and volumes of works specified in the List defined according to the offer of the contractor join in the state and (or) municipal contract and proceeding from the estimated cost of these works provided by project documentation in total cost expression shall make not less than 25% of the price of the contract (since July 1, 2018).
