Purchases of individual customers will be checked by the founding agencies. The regulation of control measures until January 1, 2019 will be developed by the Federal Executive authorities. The obligation to check the subordinated institutions will come into force on November 20, 2018.
The rules will be extended to Federal state institutions and unitary enterprises that conduct purchases under the Law No. 223-FZ. Federal authorities that perform the functions of founders or owner of the property will carry out control measures. The purpose of the control is to check whether the customers have made timely amendments to the procurement regulations on the basis of the model and whether the customer complies with the requirements of the document and Law No. 223 – FZ.
Have developed two types of audits: field and documentary. The regulation of control measures will be developed by the authorities. The deadline is 1 January 2019. The Federal body of state power will approve the term and frequency of inspections, assign a risk category to each subordinate institution, and form the procedure by which a control Commission will be formed. The authors of the document provided for a restriction: the authority can not be included in the control Commission of the representative of the customer, who plans to check.
The control Commission has the right to request documents and explanations from the customer, during the on – site inspection - freely visit the territory, premises, conduct photo and video shooting, copy documents. Condition: actions will not violate the requirements of the legislation on the protection of state, commercial and other secrets. The customer will be notified about the inspection 10 days in advance. The notification will include:
term and type of inspection, composition of the Commission;
request for documents, information;
request to provide conditions for on-site inspection. For example, provide facilities for work, communications or other equipment.
If the results of the control measures revealed signs of an administrative offense, the materials will be transferred to the FAS, if the violation contains a criminal composition – to law enforcement agencies. Materials on the results of the audit will be stored for at least three years.
