The Ministry of Finance of the Russian Federation reminded about the peculiarities of presenting information about the participants accredited before January 1, 2019 by electronic platforms
The specialists of the Ministry once again confirmed their position on the procedure for sending information and documents accredited by the operator of the electronic platform to the customer before January 1, 2019 of procurement participants included in the Register of participants of the electronic auction (article 62 of the Federal law of April 5, 2013 № 44-FZ "on the contract system in the procurement of goods, works and services for state and municipal needs"; hereinafter – the Law №44-FZ). It is, in particular, the information specified in paragraph 2 of part 11 of article 24.1 of Law No. 44-FZ, including surname, name, patronymic and position, passport data, TIN of a person entitled to act on behalf of a legal entity without a power of attorney.
So, in their opinion:
the operator of the electronic platform from July 1, 2018 to December 31, 2019 in the cases established by Law No. 44-FZ for sending information and documents provided for by part 11 of article 24.1 of Law No. 44-FZ, in respect of procurement participants accredited on the electronic platform before January 1, 2019, information and documents which are included in the Register of participants of the electronic auction, sends to the customer information and documents of such participants included in the said register;
the Commission of the customer in the cases established by the Law № 44-FZ for consideration of information and documents provided for by part 11 of article 24.1 of the Law № 44-FZ, considers the information and documents of such participants sent by the operator of the electronic platform, included in the Register of participants of the electronic auction.
Also in the letter it is noted that on the specified question the Ministry of Finance of Russia prepared changes to the Law No. 44-FZ establishing the corresponding special transitional provisions.
