The order of coordination of purchases by state-owned companies of goods defined in accordance with part 6 of Art. 3.1-1 of the Law № 223-FZ is defined
In particular, it is determined that the preparation of coordination with the coordinating body of the Government of the Russian Federation of these purchases is carried out by the Ministry of industry and trade of Russia in accordance with the application submitted by the customer and information on the purchase, the composition of which is determined by the Rules (RF Government decree of August 27, 2018 № 1000).
We remind that the features of procurement of certain types of goods, works, services, lease (including chartering, financial lease) established by article 3.1-1 of the Law No. 223-FZ apply to purchases of customers – state corporations, state companies, economic companies, in the authorized capital of which the share of participation of Russia exceeds 50%, subsidiaries, in the authorized capital of which more than 50% of shares belong to these legal entities. Thus the specified legal entities are forbidden to include operational characteristics in plans of purchases and (or) to carry out purchases of goods from the List in case their price exceeds the established limits before coordination with coordination body of the Government of the Russian Federation.
The order is valid from September 7.
