For "paper" procurement Law No. 223-FZ is not appropriate, the printout of the electronic certificate of incorporation
The participant as a part of the application for the competition under the Law N 223-FZ submitted a printout of the extract from the register, signed by the electronic signature of the tax authority. The printout was certified by the Director General of the participant. The Commission allowed the application.
However, the Management of the FAS is considered a violation. The participant had to submit the original statement or a notarized copy. This requirement is provided for in the procurement regulations.
A printout of an electronic statement signed by a tax authority cannot be considered an original. The Commission cannot verify the authenticity of the document or the electronic signature.
A similar point of view was previously held by the Ministry of economic development.
