The Russian armed forces has understood the issue of the legality of the arbitration clause in contracts under the Law N 223-FZ

The Supreme court pointed out that the law does not prohibit to transfer disputes from contracts under the Law n 223-FZ to arbitration courts.

Thus, an arbitration clause can be included in the contract, and if the decision of the arbitration court is not executed, an enforcement order can be obtained in the arbitration court.

The position of the Russian armed forces should eliminate the contradictions in the issue of the legality of the arbitration clause, which were observed in the practice of courts and agencies.
