Amendments to the Civil Code of the Russian Federation: the assignment of payment claims under the state contract is legal

Since June 1, a new version of clause 7 of Art. 448 Civil Code of the Russian Federation. The clarification was made in it: the winner of the auction has the right to concede the claim on the monetary obligation.

Previously, the RF Supreme Court in the Resolution of the Plenum on Assignment and in the Review of Practice under Law No. 44-FZ indicated the legality of such a concession.

Note that the cession of claims under contracts with a single supplier is also recognized by the courts as legitimate (AS VSO, Fourteenth AAS, Fourth AAS, Second AAS).
