The court pointed out that state customers can not artificially split the purchase
The customer concluded eight contracts with a single supplier on the same day, each amounting to less than 100 thousand rubles, to supply sports equipment for one stadium. The same day the supplier executed them. The AU of the Volga-Vyatka District recognized such actions as violating Law No. 44-FZ and the Law on Protection of Competition.
According to the court, all contracts formed a single transaction, artificially fragmented and executed by eight contracts for formal compliance with restrictions.
The customer had enough time to conduct a competitive purchase. Its absence did not lead to effective use of budgetary funds.
The only supplier got the advantage. Other business entities were deprived of the opportunity to participate in this purchase.
