The government approved a provision on the specifics of planning and procurement by customers who operate in the territory of a foreign country. It began to operate from May 15.
We list the main nuances of procurement planning:
planning purchases can be made in US dollars through the formation, approval and maintenance of the procurement plan and the procurement schedule for special forms;
the cost of acquiring compulsory insurance policies should be determined according to the legislation of the country where this purchase is conducted;
when justifying the NMCM by the market analysis method, you can additionally use data from Internet sites and other publicly available price information.
When carrying out purchases, customers should take into account the following features:
customers conclude a contract in writing (including electronic), stipulated by the legislation of the host country. If there are no corresponding norms in it - according to the customs of the business turnover of this country;
The quoting commission has the right not to reject the application if the participant has not submitted a declaration on compliance with the unified requirements. This rule will apply from July 1;
if no applications have been submitted for participation in the quotation request or all of them have been rejected, the customer is entitled to conclude a contract with a single supplier, contractor, executor;
it is possible to change the essential terms of the contract specified in cl. 95 of Law N 44-FZ, if such an opportunity is provided for in the contract;
a report on the execution of the contract must be formed in a special form;
it is not necessary to apply normative legal acts that establish prohibitions, restrictions on admission and the conditions for admission of foreign goods, works, services.
