The auction commission rejected the application of the branch. In her opinion, he could not participate in the purchase. The AC of the West Siberian District did not agree with this position.

According to the court, the branch did not act as an independent participant. His application contained information about the participant-legal entity, a power of attorney was attached to her to the director of the branch to participate in procurement. According to the Decree of the Plenum of the RF Supreme Court, transactions committed by the head of the branch in the presence of such powers are deemed to be committed on behalf of the legal entity.
