Presidium of the Supreme Court: customers under 223-FZ are entitled to prohibit subcontracting

The prohibition to attract subcontractors and co-executors corresponds to the Civil Code of the Russian Federation. The law allows to include in the contract a condition on personal performance by the contractor of works, rendering of services.
The said ban violates the law only if it is proved that with its help the customer wants to win the victory of a particular bidder.

he State Committee of the Republic of Tatarstan Procurement was awarded the certificate of the Association "ROST" for active work on building a uniform policy regarding the centralization of procurement in the region according to 44-FL and 223-FL.
The customer held an auction for the supply of monitors. Restrictions and conditions of admission were established in the purchase. No registry entries were submitted in any of the applications, so the restrictions were not applied.
