From next year these customers will need to take into account in the procurement activities the Regulation on measures to ensure the implementation of the federal budget. It establishes rules on the deadline for the adoption of budgetary obligations (conclusion of a contract), as well as on advances. The former concern only state bodies and state institutions, while the latter should apply budgetary institutions.
The new act in many respects repeats the provisions of last year's government decree.
Advancement
Customers will not be able to pay an advance at the last stage of the contract execution. It is about the contracts specified in paragraphs. "A" and "B" of clause 18 of the Regulations.
There are no other changes. So, as before, under any contract, It could be provide for a prepayment condition of up to 30% of its amount. To pay an advance in the amount of the whole price of the contract is allowed, for example, in the provision of communication services, subscription to printed publications.
As before, it will be impossible to pay advances when purchasing goods and services from the list approved by the Government.
Timeframe for contracting
Customers will have to enter into contracts no later than October 1 or the last working day before that date. There are exceptions to this rule. So, it will be possible to still accept a budgetary obligation if prior to that date the procurement notice is placed in the EIS, or the draft contract is sent to the supplier. Also, it is allowed to purchase any goods, works, services for the amount not more than 10% of the remaining money from the customer.
In order for these purchases to be possible, no later than October 6, it is necessary to send information on budget obligations to the territorial body of the Treasury Department
