The Ministry of Labor and Social Protection of the Russian Federation recalls the prohibition to give and receive gifts

On the eve of the New Year and Christmas holidays, the Ministry of Labor and Social Protection of the Russian Federation sent an information letter with a reminder of the existence of a statutory prohibition to give and receive gifts.

The Civil Code of the Russian Federation and a number of normative legal acts of the Russian Federation (federal laws "On Combating Corruption" and "On the State Civil Service of the Russian Federation") prohibit gift giving to persons replacing state and municipal posts, state and municipal employees, employees of the Bank of Russia , employees of state corporations (companies), state extra-budgetary funds, as well as to receive gifts from individuals and legal entities.

In accordance with the Civil Code of the Russian Federation, gifts received by these persons in connection with protocol events, official business trips and other official events are recognized as property of the Russian Federation, constituent entities of the Russian Federation and municipal entities.

The Ministry of Labor of Russia recalls that the receipt of gifts by the persons concerned in other cases is a violation of the prohibition, creates the conditions for the emergence of a conflict of interests, calls into question the objectivity of the decisions taken by them, and entails liability provided by law, up to dismissal in connection with the loss of confidence, and in the case , when a gift is regarded as a bribe - a criminal liability.
