The Supreme Court allowed the state customer to purchase drugs on trade names

The customer has the right to purchase any medicines by trade names, since the list of drugs that can be purchased is not approved. At the same time, there must be a need for purchased drugs and for purchasing a trade name for the drug. Such conclusions were cited by Supreme Court of Russian Federation in paragraph 24 of the Judicial Review No. 4 (2017).

Recall, according to the № 44 federal law, the customer can indicate the trade names of medicines in the documentation if he:

- Request for proposals for the purchase of drugs necessary for prescribing to the patient as decided by the medical commission;

- purchase of medicines from a special list. Until it is approved;

- competition based on art. 111.4 of № 44 Federal Law.
