FAS explained how the state customer to establish in the expiration date of medicinal products

10 November 2017, Friday

In its letter, the antimonopoly service noted:

- The remaining shelf life should be justified. It should be determined by a specific date or period (for example, in years, months, days) during which the drug can be used for its intended purpose;

- this period should correspond to the planned period of drug use, but this rule can be retreated for objective reasons;

- you can indicate the period using the phrase "not less". If the participant offers a drug with a shelf life exceeding the required one, it is impossible to reject the application;

- do not need to set the remaining life of the drug in percent. This can limit competition and the number of participants;

- You can not require participants to specify the period in the application.

It should be noted that the antimonopoly authority previously concluded that the remaining shelf life should not be set as a percentage. However, in judicial practice, there is another opinion.
