So considers the Ministry of Economic Development.
We believe, explanations will be useful if the quoted bid was signed by the representative of the participant, but the power of attorney isn't attached to it.
The ministry reminded in what cases it is possible to reject the quoted bid:
- the request doesn't conform to requirements of the notice;
- suggested price exceeds the starting (maximum) price of the contract;
- the procurement participant didn't submit required documents and information in the request.
It is important that the exhaustive list of such documents and specifying on necessary information is in the Law N 44-FZ. The power of attorney among documents isn't called therefore its absence - not the basis to reject the request.
If the state customer nevertheless rejects the quoted bid due to the lack of the power of attorney, his official is threatened by a penalty. The size of a penalty constitutes 5% of the starting (maximum) price of the contract, but no more than 30 thousand rubles.
