The Ministry of Finance clarified the payment procedure for small purchases under 44-FZ
The Russian Ministry of Finance clarified the procedure for payment of contracts under clauses 4 and 5 of Part 1 of Article 93 of Law No. 44-FZ. Starting from July 1, 2026, such purchases will be included in the register according to special rules established by the Government of the Russian Federation.
According to Part 8 of Article 103 of Law No. 44-FZ, a contract cannot be paid if information about it is not available in the registry. However, from July 1, 2026, transitional provisions apply for individual purchases from a single supplier. In accordance with subparagraph "u" of paragraph 2 of Decree of the Government of the Russian Federation No. 60 dated 01/27/2022 (as amended on 05/23/2026 No. 590), customers have the right not to send data on each contract in the general order, but to submit a single list of such contracts to the Treasury through the Unified Information System by May 1, 2028.
Thus, the payment of contracts under clauses 4 and 5 of Part 1 of Article 93, information about which is included in the register through the specified list, does not contradict the requirements of the law. The Ministry of Finance's clarification confirms that the transitional procedure does not block payment for such purchases.
