FAS: in case of a failed purchase, the sole supplier must comply with all the requirements of the notification
The FAS of Russia clarified that the customer does not have the right to reduce the requirements for a single supplier when concluding a contract under clause 25, Part 1, Article 93 of Law No. 44-FZ, if the purchase is declared invalid.
The Agency recalled that the contract in this case is concluded on the terms of the notification. This means that the sole supplier must comply with all the requirements of art. 31 of Law No. 44-FZ, including additional ones that were established during the competitive procedure (for example, by Decree of the Government of the Russian Federation No. 2571).
Thus, if additional requirements were provided for in the notification, their observance remains mandatory even when concluding a contract with a single supplier. Rejecting them is not allowed.
