The right of the self-employed to participate in public procurement is confirmed
Experts from the Ministry of Finance have confirmed the right of self-employed citizens to participate in procurement conducted under Federal Law No. 44-FZ. According to the letter of the Ministry of Finance dated April 24, 2025 No. 24-06-09/41454, any individual, including registered individual entrepreneurs, has the right to apply for contracts based on the results of auctions and auctions.
The restriction applies only to offshore companies, as well as legal entities and individuals who are foreign agents. Such persons are not allowed to participate in the procurement procedures. The document recalls that participants in public procurement are required to comply with the requirements of the law and the rules of the procurement procedure.
Thus, the status of a self-employed citizen is not an obstacle to participation in auctions and auctions under federal legislation on the contract system.
