FAS clarified the rules for calculating NMCC when purchasing fuel

On February 3, 2025, new rules for determining the initial contract price (NMCC), the contract price when working with a single supplier, as well as the unit price for purchases of motor fuel came into force. The Federal Antimonopoly Service (FAS) has published clarifications on key issues raised by customers. Let's consider the main points.

How do I calculate the conversion rate to a seasonal type of fuel?

If there is no current data on the price of the required type of fuel at the time of calculation, the conversion factor is applied. It is calculated as the ratio of the price of fuel that opens the season to the price of fuel that ends the season. For this purpose, statistics for the same period of the previous year are used, taking into account climatic features.

Example: when purchasing summer diesel fuel in June with delivery in November, the coefficient is determined based on the price ratio of winter diesel to summer diesel.

Which sources of price information should I choose if the data varies?

If the customer comes across different data from the Central Department of Fuel and Energy, the regional department of Rosstat and EMISS, he has the right to choose the appropriate source independently — the list of statistical resources is open.

What should I do if the auction did not take place due to a lack of bids?

If the auction is cancelled due to a lack of offers, the re-purchase is carried out in accordance with the general rules of Law No. 44-FZ.

Is it possible to use data from regional divisions of Rosstat?

Yes, it is allowed. The websites of the regional offices of Rosstat are included in the list of acceptable sources of statistical information.

How to account for the supply of fuel to different regions?

If fuel is supplied to several regions at once, the market price is determined as the arithmetic average of all planned supply regions.
