A law on amendments to certain provisions of Law No. 44-FZ has been adopted
On 12/26/2024, Federal Law No. 494-FZ of 12/26/2024 was published, which amends certain provisions of Law No. 44-FZ and provides for the following innovations:
- there is no restriction on the total annual volume of purchases when making an electronic request for quotations
- purchases carried out in cases established by the Government of the Russian Federation are excluded from the calculation of the SGOZ for the purposes of determining the volume of purchases from small businesses and socially oriented non-profit organizations in accordance with Part 1 of Article 30 of Law No. 44-FZ.
In addition, the Law extends until the end of 2025 part of the provisions provided for in Article 112 of Law No. 44-FZ, namely the possibility of:
- inclusion in the subject of the contract at the same time the preparation of project documentation and (or) the performance of engineering surveys, construction, reconstruction, and major repairs of the capital construction facility
- inclusion in the contract of conditions for the supply of equipment provided for in the design documentation of the capital construction facility
- changes in the essential terms of the contract based on a decision of the Government of the Russian Federation, the supreme executive body of the subject of the Russian Federation or the local administration, if circumstances beyond the control of the parties arose during the execution of such a contract, resulting in the impossibility of its execution
- changes in the quantity and price of the contract for the supply of medicines, medical devices and consumables by no more than 30%
- the implementation of purchases by individual customers in accordance with paragraph 4 of part 1 of Article 93 of Law No. 44-FZ, without taking into account the limitation in terms of the maximum size of the CDF of 50 million rubles
The law comes into force on 01.01.2025, with the exception of certain provisions.
