A new version of the draft Government decree amending the rules of import substitution from 01.01.2025 has been posted

On the website of the Ministry of Finance of the Russian Federation, the draft decree of the Government of the Russian Federation "On measures to provide national treatment in the procurement of goods, works, services for state and municipal needs, purchases of goods, works, services by certain types of legal entities, on the amendment and invalidation of certain acts of the Government of the Russian Federation" is posted as of 12/22/2024

The Ministry of Finance of the Russian Federation presented a revised version of the draft government decree, where it proposed to use the "second superfluous" mechanism exclusively in relation to drugs from the list of VED and the list of strategically important medicines (SZLS) when purchasing medicines. Such a mechanism implies the rejection of applications with a proposal for the supply of a foreign product if at least one proposal for the supply of a medicine of Russian origin is received. The first version of the document was submitted at the end of August 2024, but it did not contain a list of drugs for which such an order is planned to be used, which caused concern among pharmaceutical associations and the patient community.

In the explanatory note to the updated draft, the Ministry of Finance indicated that a thematic clarification was made to the regulations being developed on the provision of national treatment in public procurement at the suggestion of the Ministry of Industry and Trade and the Ministry of Health of the Russian Federation.
