Procurement participants will confirm compliance with additional requirements in a new way

Resolution of the Government of the Russian Federation dated September 23, 2024 No. 1285

The Government has made a number of amendments to Resolution No. 2571 dated 12/29/2021 "On Requirements for participants in the procurement of Goods, works, services for State and municipal needs and Invalidation of certain Acts and Certain Provisions of Acts of the Government of the Russian Federation."

In particular, in accordance with these changes, a rule has been established according to which the corresponding position of the annex to Resolution No. 2571 is applied regardless of the scope of the customer's activities.

In addition, the list of annex items has changed, in order to confirm compliance with additional requirements for which participants must provide only a contract concluded and executed in accordance with Law No. 44-FZ, or a contract concluded and executed in accordance with law No. 223-FZ. It is specified that for the purposes of updating No. 2571, the concept of "construction contract" is used in the meaning provided for in Part 2 of Article 52 of the Civil Code of the Russian Federation. The provided sub-items "g" of the item have been clarified. 3 of Resolution No. 2571 features of confirmation of work experience in the field of urban development.

Additional requirements for private owners provided for in separate items of the Appendix, including those related to the procurement of construction works and catering services, as well as a list of information and documents confirming compliance with them, have also been adjusted.

The appendix has been supplemented with a new clause 36.1, which provides additional requirements for participants in the procurement of services for washing, cleaning (including chemical) textile products.

These changes will enter into force on October 4 of this year and will apply to relations related to the implementation of purchases, notices of which are posted in the EIS after the specified date.
