Is it possible to change the price of a contract stage if the deadline for the stage is changed?
According to specialists of the Ministry of Finance of the Russian Federation, in the event that the deadline for the execution of a separate stage (separate stages) of contract execution changes within the contract execution period, a change in the price of the stages of contract execution is allowed on the basis of Part 65.1 of Article 112 of Law No. 44-FL, which provides for the possibility of change by agreement of the parties on the basis of a decision of the Government of the Russian Federation, the highest executive body of a constituent entity of the Russian Federation, local administration of any essential terms of contracts.
Let us remind you that on the basis of clause 12 of part 1 of Article 95 of Law No. 44-FL, it is allowed to change the terms of the contract if, during its execution, the execution time of a separate stage (separate stages) of the contract execution changes. In this case, it is allowed to change only the execution time of a separate stage (separate stages) of contract execution within the framework of the contract execution period provided for at its conclusion.
